These terms and conditions (the "Terms and Conditions") govern the use of www.confidentmaids.com (the "Site"). This Site is owned and operated by Confident Maids, LLC. This Site is a online bookings for cleaning services.
The Terms of Service form a referral agreement between the client and Confident Maids Referral Agency, which operates as an employment/domestic referral agency connecting clients with independent house cleaners and other service providers.
These terms apply to anyone who visits or uses Confident Maids LLC’s website or services, including potential, current, and former customers. By using them, you confirm that you are at least 18 years old and legally able to enter into a binding contract.
By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.
Intellectual Property
All content published and made available on our Site is the property of Confident Maids, LLC. and the Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.
User Contributions
Users may post the following information on our Site:
- Photos;
- Videos; and
- Public comments.
By posting publicly on our Site, you agree not to act illegally or violate these Terms and Conditions.
Accounts
When you create an account on our Site, you agree to the following:
1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and
2. All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.
We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.
Sale of Services
These Terms and Conditions govern the sale of services available on our Site.
The following services are available on our Site:
- 1 Time Home Cleaning Services; and
- Reoccurring Home Cleaning Services.
The services will be paid for in full upon the completion of the service.
These Terms and Conditions apply to all the services that are displayed on our Site at the time you access it. All information, descriptions, or images that we provide about our services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all services we provide. You agree to purchase services from our Site at your own risk.
We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.
Subscriptions
Your subscription automatically renews and you will be automatically billed until we receive notification that you want to cancel the subscription.
To cancel your subscription, please follow these steps: We don't charge any cancellation fees or rescheduling fees as long as we have a 24 business hour notice Monday - Friday 7am - 11pm est. Call Phone Number to cancel your services if need be.
Payments
We accept the following payment methods on our Site:
- Credit Card;
- Debit; and
- Direct Debit.
Payment: Payment is due at the time service is scheduled. Client may provide Agency with a valid credit card to keep on file for billing. Client is responsible for and agrees to pay Agency for the full cost of Client’s requested services. The referral fee charged by Agency for its services shall be reasonable, negotiable and based on a fixed percentage of the service cost per the Agency’s established fee schedule. Without exception there are no refunds for the cleaning service
When you provide us with your payment information, you authorize our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorize us to charge the amount due to this payment instrument. If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to
cancel or reverse your transaction.
Refunds for Services
Confident Maids offer NO REFUNDS once the service is completed. Without exception there are no refunds for the cleaning service. In the event the signed customer claims a chargeback on their credit or debit card for the services that were provided by Confident Maids, and the card issuer determines that the customer has committed fraud by requesting a charge back, the signed customer shall pay Liquidated Damages to the Agency at the amount of $750.00 in addition to the cost of service per occurrence.
Cancellation
Failure to notify Agency twenty-four (24) hours in advance of cancellation of any requested service will result in a $50 fee charged for the scheduled visit. There are no refunds for the cancellation charge unless the client has been excused by the agency of the $50 fee due to an emergency considered valid by Confident Maids Referral Agency.
Rescheduling
If you need to reschedule a booked cleaning appointment, you must notify us at least 24 hours in advance. Failure to provide sufficient notice may result in a cancellation fee.
Lock Out or No-Show
Clients must ensure access for cleaning; if the service provider cannot enter due to a lockout or no-show, a $50 fee applies. This fee is non-refundable unless the agency waives it due to a valid emergency.
Direct Hiring Prohibited
Clients may not directly hire referred service providers during the agreement or for nine months after it ends without notifying the agency; otherwise, a $5,000 finder’s fee applies.
Performance of Services
Service providers are independent and solely responsible for their work and resolving any complaints directly with the client. The agency is not liable for service issues, and clients agree to indemnify the agency; all cleaning services are non-refundable.
Independent Domestic Worker
Agency is not the employer of the domestic worker referred to Client. Client acknowledges that she or he may have employer responsibilities depending upon the nature of the professional relationship established with the referred Service Provider and thus, may be liable for payment of State and/or Federal employment taxes incurred during and throughout the course of the engagement. In addition, Client acknowledges that Agency shall not be liable, and Client agrees to indemnify Agency from and against any claims, losses, costs, fees, liabilities, damages, or injuries arising out of Client’s failure to pay any such taxes.
Consumer Protection Law
Where any consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.
Limitation of Liability
Confident Maids, LLC. and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.
Indemnity
Except where prohibited by law, by using this Site you indemnify and hold harmless Confident Maids, LLC. and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.
Applicable Law
These Terms and Conditions are governed by the laws of the State of NJ
Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.
Attorney’s Fees
Client agrees to pay all reasonable costs, including, but not limited to, attorney’s fees incurred by the Agency to enforce any provision in this Agreement.
Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a
notice on our Site.
